This policy explains how cancellation, the statutory cooling-off period and refunds work for paid ActuallySpeak subscriptions and one-off purchases (including live class bookings). It forms part of our Terms of Service. ActuallySpeak is operated by Matthew Fabling, a sole trader trading as "Smooth English", in connection with [Smooth English Company — VERIFY legal entity name and registered address].
When you create an ActuallySpeak account we unlock full access for 7 days inside the app. It costs nothing, it does not ask for a card, and it is granted once per person. It is not a subscription: it does not renew, and nothing is charged when it ends. If ActuallySpeak is not for you, simply stop using it — there is nothing to cancel and nothing to pay.
Subscribing is a separate, paid step. All three plans (General English Pro, IELTS Premium Monthly, IELTS Premium Annual) take your first payment on the day you subscribe. There is no additional free period at checkout, so please use your free week to decide before you pay. Your statutory 14-day cooling-off right, explained in section 2, still applies to that first payment.
Because you buy online without meeting us in person, your subscription is a "distance contract" under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This gives you the right to cancel within 14 days of entering into the contract, without giving a reason.
ActuallySpeak is a digital service that we make available to you immediately. When you tick the box to agree to our terms at checkout, you expressly ask us to start providing the service straight away and you acknowledge that you will lose your right to cancel once the service has been fully supplied. In practice:
To use this right, email actuallyspeak.help@gmail.com with the email address on your account. You may use the model cancellation wording: "I hereby give notice that I cancel my contract for the ActuallySpeak subscription."
Once the 14-day cooling-off period has passed, we do not refund the period you have already paid for. You can cancel at any time to stop the next renewal, and you keep full access until the end of your current paid period.
| Plan | Price | If you cancel |
|---|---|---|
| General English Pro | £2.99 / month | Within 14 days of first charge: refundable (less any use). After that: cancel stops the next monthly charge; access continues to month end. |
| IELTS Premium Monthly | £4.99 / month | Same as above. |
| IELTS Premium Annual | £29.50 / year | Within 14 days of first charge: refundable (less any use). After that: the remainder of the year is non-refundable, but you can cancel to prevent renewal next year. |
You can cancel in either of these ways — it takes a minute and is as easy as joining:
Cancellation stops future renewals. You are not locked into any minimum term beyond the period you have already paid for.
Under the Consumer Rights Act 2015, the digital service must be of satisfactory quality, fit for purpose and as described. If it is faulty or not as described and we cannot fix it within a reasonable time, you may be entitled to a price reduction or a refund. These statutory rights apply in addition to everything above and cannot be taken away by this policy.
If you think you have been charged in error, please contact us first — we will almost always resolve it quickly. Raising a bank chargeback without contacting us may result in your account being suspended while the dispute is investigated.
Live classes booked through the Academy timetable are paid for individually via Stripe Checkout. The following cancellation policy applies to each booking:
[PLACEHOLDER — confirm before publishing:]
To cancel a class booking, use the cancellation option in the timetable (where available) or email actuallyspeak.help@gmail.com from your account email, quoting the class date and time. Refunds are returned via Stripe to your original payment method, normally within 5–10 business days.
If a class is not delivered as described, or a technical failure on our side prevents it from taking place, your statutory rights under the Consumer Rights Act 2015 apply as set out in section 6 — regardless of the timings above.
The two kinds of payment work differently, so here is the distinction in plain terms:
